Instagram competition rules 21.2.2020 - 10.3.2020

The text below presents the full rules of the Instagram competition (hereinafter referred to as the “competition”). This is the only text that completely and bindingly regulates the rules of the competition.

  1. Organizer and organizer of the competition The organizer and organizer of the competition is the company Zuzana Bukáčková, registered office Rakouská 549, 289 24 Milovice – Mladá,
    IČ: 03406890 (hereinafter referred to as the “organizer”). The organizer of the electronic social network Instagram (hereinafter referred to as the “Instagram network”) is not the organizer or organizer.
  2. Time and place of the competition The competition will take place on 21.2.2020-10.3.2020 (hereinafter referred to as the “time of the competition”) on the Internet and on the territory of the Czech Republic and abroad in the places specified in the rules.
  3. Competitors The competition is open to a natural person over the age of 18 with a delivery address in the Czech Republic who meets the competition rules. The following rules apply (among other things) to the participants of the competition – fans of the instagram page purebeautybysuzi.cz (hereinafter also only “fans”):

3.1. The condition for participation in the competition is to be registered as an Instagram user and to be a fan of the Pure Beauty by Suzi instagram page (@pure_beauty_by_suzi) at the moment when the person interested in participating in the competition wants to participate in the competition.

3.2. Each competitor must be able to prove the authenticity of his instagram profile at any time.

3.3. Contestants must abide by all Instagram rules. Each competitor can participate only once . Persons in an employment or similar relationship with the organizer, the organizer or other persons authorized to organize this competition and persons who are close to any of such persons in relation to any of such persons are excluded from the competition. Photographs, texts, drawings or other creations and communications that the contestant publishes within the competition (hereinafter collectively referred to as “inserted material ) must not contravene the legislation of the Czech Republic, must not endanger the moral education of children and youth and must be ethical (especially must not contain pornography , violence, vulgarity, racial intolerance, etc.).

By entering the competition, the contestant, by publishing the comments together with the following details, confirms that: – he / she is the sole author of all submitted material, or that he / she has the proper consent of the (co) authors of the inserted material;

– has the proper consent of all persons captured on the inserted material;

– has the proper consent of the owners of any items, trademarks, trade names and other similar intangible assets captured on the submitted material, all for the use of the inserted material in the competition in accordance with these rules and the rules of the Instagram network. A person who does not meet any of the conditions of participation set out in these rules may not participate in the competition and, if he participates in the competition, is not entitled to win and may be excluded from the competition at any time without compensation.

  1. Competition mechanism

On 21.2.2020-10.3.2020, fans have the opportunity to post their answers in a comment on the Instagram network

– Only one of the answers published by the participant will be included in the competition – the answer must be published in the comment

– Contestant must follow Pure Beauty by Suzi instagram profile (@pure_beauty_by_suzi)

– The participant of the competition must like (indicate that he / she likes) the competition entry, further mark in the comment 2 friends via the symbol “@”, who would also like to win the prize

  1. Competition wins and their announcements

The winner will receive a body and hair shower shampoo from the Austrian brand Susanne Kaufmann. The name of the winner will be announced on the Instagram page (@pure_beauty_by_suzi). Winners will be invited to send their delivery details and other contact information in a private message. If the winning fans do not deliver the contact information according to the instructions in the invitation, they lose the right to the prize and it loses in favor of the organizer.

Entitlement to the prize is further lost by a competitor who does not meet any of the conditions for participation in the competition or does not prove its fulfillment, and also by a competitor who otherwise acts in violation of these rules or who is excluded from the competition. In the event that a prize has already been awarded to the excluded competitor, he is obliged to return it and, if this is not possible, to pay the organizer the value of the prize in cash; this does not affect the liability of the participant for damages, including the intangible, the organizer, organizer and / or third parties. There is no legal right to winnings and it is not possible to exchange them for cash or demand other performance instead.

  1. Transfer of prizes

The winners will be sent to the addresses specified by courier or post. Competitors’ prizes that cannot be delivered for reasons other than those of the organizer or organizer will be forfeited in favor of the organizer.

7. Copyright, consent to the processing of personal data and approval of rules

By entering the competition, the competitor agrees with the rules of the competition. By entering the competition, the competitor grants the organizer and the organizer, free of charge, the exclusive right to exercise the right to use the inserted material for all uses listed in Act No. 121/2000 Coll., Copyright Act (reproduction, distribution, communication to the public via the Internet visually, etc.) to an unlimited extent in time, territory and quantity, in printed, electronic or other form, in connection with the competition or for other marketing purposes of the organizer and / or organizer of the competition. The competitor undertakes to compensate the organizer or the organizer in case of any damage, even non-material, caused to them as a result of the placement of the inserted material in violation of these rules or the rules of the Instagram network.

By participating in the competition, the contestant further agrees that the organizer and the organizer are entitled to make video, audio and audio-visual recordings of the winners of the competition or collect their expressions of personal nature, and to publish names and surnames or video, audio, visual and audio recordings concerning the winners. or their expressions of a personal nature (video, photographs, writing, voice, etc.), in the media, on the Internet or in any other promotional materials and means of the organizer, all free of charge and without limitation of place, time, quantity and method of use.

By entering the competition, competitors:

– agrees, in accordance with Act No. 101/2000 Sb. on the protection of personal data, as amended (hereinafter referred to as the “Act ), with the processing of their personal data provided in the competition to the organizer and organizer for marketing purposes, ie. e.g. to offer trade and services, until such consent is revoked in writing;

– confirms that he has been informed by the organizer as a controller of personal data, or on his behalf by the organizer as a processor of personal data, of all rights arising from the law, ie. in particular, that the provision of such data is voluntary, that he has the right of access to them, as well as other rights arising from this Act. The participant of the competition acknowledges that the consent to the processing of personal data may be revoked at any time. The data provided by the competition participant may, in addition to the organizer and the organizer of the competition, be processed by other persons authorized by the organizer or the organizer of the competition, in the usual way for processing data for marketing purposes.

The processed data will be made available to the organizer or organizer of the competition, to all processors and persons otherwise involved in the implementation of the competition or other marketing events of the organizer or organizer of the competition, or to the person to whom the organizer or organizer of the competition passes the data. The participant in the competition agrees in accordance with the provisions of Section 7 of Act No. 480/2004 Coll., On Certain Information Society Services, as amended, to the sending of commercial communications by all electronic means. The participant of the competition is aware that his / her consent to the sending of commercial messages and e-mails for the purpose of direct marketing may be revoked at any time in the form of written information at the organizer’s address.

  1. Other terms and conditions of the competition

9.1. The organizer reserves the right to change the rules or conditions of the competition at any time, including a change in its duration, or to interrupt or terminate the competition at any time without compensation, with effect from the date of publication on the nejloznice.cz website and on the NejLožnice.cz instagram profile.

9.2. If the organizer has a reasonable suspicion of fraudulent, dishonest or unfair conduct by a competitor or other person who has helped or may have helped the competitor to win, or if such conduct occurs, the competitor may be excluded from the competition without compensation; this also applies in the case of other actions of the competitor or another person who helped or could have helped the competitor to win, which is otherwise in conflict with the competition rules or conditions or with the general principles of fair competition and fair play. The decision of the organizer or the organizer to exclude from the competition is final, without the possibility of appeal.

9.3. The organizer and the organizer reserve the right to consider as fraudulent such instagram accounts that have less than 30 followers, and to exclude a competitor with such an account from the competition without compensation.

9.4. The organizer is not responsible for any technical problems in connection with participation in the competition (especially for the functionality of the Internet and the electronic social network Instagram) or for the actions of third parties on the social network Instagram or elsewhere on the Internet.

9.5. Neither the organizer nor the organizer of the competition is liable for loss, non-delivery, delay or damage to the prize after it has been handed over to the delivery person (post office, courier, etc.).

9.6. Neither the organizer nor the organizer is responsible for any damages caused by the preparation or implementation of any competition acts, participation in the competition or winnings in the competition or in connection with them.

9.7. Participation in the competition or the prize cannot be enforced in court.

9.8. This contest is not sponsored, administered or affiliated with Instagram. The competitor does not provide the information provided in the competition to the Instagram network operator. All questions, comments or complaints must be directed to the organizer, not the Instagram operator.

9.9. In other respects, the competition and the relations between the competitors and the organizer and the organizer are governed by the law of the Czech Republic, to the exclusion of conflicting rules of private international law.
